This Licence Agreement is incorporated into, and forms part of, the Terms of Service between you and Cornerstone SWMS (ABN 67 549 365 260). It governs your use of the Safe Work Method Statements (SWMS) and Standard Operating Procedures (SOP) purchased from or made available through the Platform. By purchasing and downloading any document, you agree to the terms set out below. Capitalised terms have the meaning given in the Terms of Service.
Cornerstone SWMS grants you a non-exclusive, non-transferable, revocable licence to use each purchased document for your internal business operations at a single PCBU (Person Conducting a Business or Undertaking). You may:
You may not, under any circumstances:
All documents remain the intellectual property of Cornerstone SWMS. The purchase price grants you a licence to use the document — it does not transfer ownership of the underlying content, templates, or structure.
The documents provided are templates and starting points only. They are not legal advice and do not constitute a guarantee of compliance with any law, regulation, or code of practice. Each document must be reviewed, adapted, and approved by the PCBU — or facilitated by a designated WHS Manager, Site Supervisor, or Principal Contractor — before use at any specific worksite. Site-specific hazards, conditions, and legislative requirements may vary.
Work health and safety legislation differs between states and territories. You remain responsible for ensuring that any document you use meets your obligations under the Work Health and Safety Act (or, in Victoria and Western Australia, the equivalent occupational health and safety legislation applicable in that jurisdiction) and any associated regulations. You should confirm that a document is appropriate for the specific jurisdiction in which the work is being carried out.
When you purchase a document, the details saved in your My Account profile — which may include your PCBU name, ABN, worksite address, project name, site address, principal contractor, prepared-by details, contact information, and company logo — are embedded into the generated PDF. You are responsible for ensuring this information is accurate before purchase, as documents are generated automatically at the point of sale and reflect your profile data as it stands at that time.
Where the Platform makes free sample documents available, those samples are licensed to you on the same terms as purchased documents, except that they may be watermarked or contain limited content. Free samples are provided for evaluation purposes only and may not be resold, redistributed, or used in a live workplace without first being purchased and customised. We may modify, restrict, or withdraw the availability of free samples at any time.
Where you purchase a bundle combining a SWMS with related SOPs, this licence applies to each document within the bundle on an individual basis. Each document is licensed for use at a single PCBU, and the bundle discount does not extend the scope of the licence beyond that set out in section 1.
This licence is granted upon successful payment and remains in effect until terminated. Cornerstone SWMS may terminate this licence if you breach any term of this agreement. Upon termination, you must cease using the documents and destroy all copies, though you may retain documents already customised and approved for use at an active worksite.
As documents are digital goods delivered and generated automatically upon purchase, refunds are generally not available once a document has been downloaded or generated. If you experience a technical failure that prevents you from receiving your purchased document, please contact us and we will resolve the issue or provide a replacement.
Nothing in this Licence Agreement excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that can't lawfully be excluded, restricted, or modified. If a document fails to meet a consumer guarantee, you may be entitled to a repair, replacement, or refund depending on the nature of the failure.
This Licence Agreement is governed by the laws of Queensland, Australia. Subject to any right you may have under the Australian Consumer Law to bring proceedings elsewhere, each party submits to the non-exclusive jurisdiction of the courts of Queensland.
